Advice needed with insurance claim.
More than a year ago I had a accident wich wasn't my fault.
A interlink from ##### Vervoer stopped in front of me on my way to work, and suddenly started backing up eventually pushing my car back 3meters.
The driver (and later witness) behind me drove around and stopped the truckdriver from backing up.
Its kind of hard to get your car from first into reverse when your going backwards.....
Anyway, long story short, the driver had a printed claim form that needed all the parties enolved's details.
Me, the witness even the traffic officer that showed up.
So to me it looked like a done deal, these people have been down this road before, I mean they have all these forms??
Well now 20 months later, I've been told that they dont have insurance and later needed the witness statements (again!!)
This week, at last it looks like my insurance is at a point that have these guys cornered and it just might settle before 2015.
* And yes, it turned out they had insurance all the time.....
Now my question:
I had to fix the car with my insurance, which increased my mounthly installment.
They obviously reclaim from their(#### Vervoer) insurance, but I had to pay the penalty.
Can I claim this back?
Also from who do I claim this?
I was told that my installment would reset to what it was prior to the claim.
But if I add up all the "extra installments" I had to pay the last 20 months while they've been doding my claim, it comes to quite a large sum of money.

AFAIK your insurer only pay you back your excess amount (maybe the premium hike but I doubt this). They keep anything extra they get from the ### Vervoer insurers

Cobus I went through something similar last year.
person from company A jumps in the bakkie of company B and backs up - taking out the front fender of my Etios with 9 500 km on the clock !! All this WHILE I stand 10 m away and SEE it happen.
I claim from MY insurer. car fixed, me paying the excess.
NOW my insurers legal team takes on Company B (OWNERS of the vehicle) .... they decline to claim from their insurers, stating: "It was NOT our driver, take on the driver at the time ..."
At this point my broker explains to me that due the small claim value she does NOT expect the insurer to spend too much time on the issue .... they send ONE letter: "claim (damage) amount R12k. IF you agree to settle in 30 days we will settle for R8k ..." Young chap did NOT get proper advise and settled ....
Thus I was LUCKY, and got my excess back, and no premium increase.
Moral of the story - you deal with your insurer. your insurer deals with the OWNER. IF you are LUCKY all parties play nicely .... fleet owners KNOW the drill and will try to avoid payment ....
Once your insurer declares the case CLOSED, thats it - in terms of your insurance.
APPARENTLY you can then take the OWNER and\or the driver on in small claims court ....

If you have the time summons the owner too small claims court for your losses as he has to appear himself and he will more than likely settle due to his time not being worth the money owed.

En small claims court met dagvaardiging en prokerower kostes is maklik R10k... Mens moet die goed maar opweeg teen mekaar...

Dieselfde met my gebeur. Ek staan doodstil en nuwe SA ry in my vas - remme werk nie! Versekering premie die hoogte in (plus bybetaling) en die versekeringsmtskpy sê dis nie die moeite werd om iemand te vervolg wat nie geld het om te betaal nie, howe is vol, polisie is besig (om omkoopgeld te vat) en die onkoste is te hoog en die tronke is vol... Nou moet ek maar hoes...... Hoekom verseker jy jou voertuig is my vraag? Maak dit verpligtend soos bv in VSA waar die jaarlikse lisensiegeld deel van die versekering is. Maar ongelukkig is die padongelukke fonds bankrot (raai hoekom?) en ons almal weet wat van die geld sal word as so skema ingestel word.... Dalk word daar 'n rugbystadion langs die sokkerstadion by Nkandla gebou?

Hierdie is 'n algemene probleem! Totdat dit nie wetgewing raak dat alle voertuie wat 'n openbare pad gebruik, verplig word om versekering uit te neem, sal dit altyd 'n tammaletjie bly!
Cobus jou makelaar moet die stryd namens jou stry. Daar is egter geen waarborg dat 'n verhaling ooit suksesvol afgehandel sal word nie. Ons het eise wat in 12 jaar nog nie gefinaliseer is nie. Mense raak weg .... Onthou ook dat indien jou versekeraar vir jou skade betaal het, kan jy nie sommer die reg in jou eie hande neem nie. Jy benadeel jou eie regte. Ongelukkig verhaal 'n onderskrywer eers hul gedeelte wat hul uitbetaal het en dan jou bybetaling. Indien die verhaling suksesvol is, bleik dit nooit 'n problem te wees nie. My ervaring is dat jou bybetaling terugbetaal word (as verhaling suksesvol is), maar dat jou premie nie altyd aangepas word na die premie voor die verlies plaasgevind het nie.
Verder meer kan ek ook bevestig dat dit bykans onmoontlik is om 'n verhaling te doen by die direkte versekereaars. Hul kiente is net nooit skuldig nie. Daar bestaan nie werklik meer 'n "knock vir knock" ooreenkoms tussen die tradisionele versekeraars nie, maar hul derde party eise word defnetief met meer omsigtigheid hanteer. Laastens moet jy ook besef dat die verhalingsdepartement 'n "sagte" werk is en dat daar nie daaglikse druk is soos in die eise of onderskrywingsdepartement nie. Ongelukkig gebruik baie onderskrywers die afdeling om hul BEE poste te vul.

So my eerste prys sal wees dat ek my "saamgestelde verhooging van bybetalings premie" kan verhaal vir die tydperk wat ek dit moes betaal het PLUS die terug skaling van die premie na wat dit was voor die eis.
Tweede prys is dat ek ten minste net die terug skaling van die premie kan kry.
Maar soos julle almal hier noem, dis 'n hopelose saak. Jy praat via 3 mense om die geveg vir jou te veg.
Indien jy nie familie het wat in die bedryf is en dit vir jou doen nie, bly jy maar net 'n nommer op 'n waglys.
Terloops, soos met UK se M.O.T(verpligte versekering op alle voetuie wat 'n lensesie skyfie het), is dit glo in die pyplyn dat hulle dit wel wil toepas in SA. Hoop dit gebeur, maar ja daai fondse gaan ook aanloklik wees. :roll:

Vat nou ma my Polo...versekering skryf hom af, gee my retail wat maar R70k is, en verkoop die parte vir omtrent R40k, want ek moes hom oor teken aan hulle met spaar sleutels en al...
Kan ook ni wen ni...en om daai Polo te vervang is al oor die R200k, beleaglik vir Audi se weggooi tegnologie....
